Terms of Service

These Terms of Service (“Terms”) are a plain-language agreement between you and CSRA Night & Day (“we,” “us,” or “the site”). Please read them before using the site or submitting anything to us.

Effective date: 23 September 2026.

1. Accepting These Terms

By visiting the site, submitting a business or event, or purchasing an advertising or feature service, you agree to these Terms. If you do not agree, please do not use the site. If you are submitting on behalf of a business, you confirm you have the authority to act for that business. You must be at least 18 to submit a business or buy a paid service. Our Privacy Policy explains how we handle personal information and is part of these Terms.

2. What This Site Is

CSRA Night & Day is a local discovery site for the Central Savannah River Area, including the Augusta, Georgia area and Aiken and North Augusta, South Carolina. We publish editorial business listings, curated guides, an events calendar, and a blog.

A basic listing is free and always will be. Listings are hand-picked by us. There are no user accounts and no online checkout on the site at this time. A free listing costs nothing and requires no payment details. Optional paid services are arranged directly with us and billed as described in Section 6.

3. Editorial Independence

Our listings and guides are editorial choices. We decide what to publish, feature, and recommend based on our own judgment of what serves the local community.

Payment never guarantees a listing, a ranking, or a recommendation. Paid features buy visibility for content we have already chosen to publish. They do not buy our opinion. Paying us never changes where a listing appears in our listing pages, which are sorted A to Z.

Paid features are labeled, so readers can tell sponsored placement apart from editorial content. That includes paid coverage on our social media channels, which we identify as paid or sponsored as federal advertising rules require.

We apply content standards to everything on the site. We do not publish sexual content, political content, or religious content with strong messaging or persuasion. Content should be positive, helpful, and community-serving. We may decline or remove any listing or content at any time, for any reason consistent with these standards, including businesses whose reputation or ratings require additional review.

4. Business Submissions

If you submit your business, an event, or other materials through our forms, every submission is reviewed by a person. Nothing publishes automatically.

We are not obligated to publish anything. Submitting does not create a right to appear on the site, and we may edit, decline, or later remove a listing at our discretion.

You are responsible for accuracy. You confirm that the information you give us (names, hours, prices, descriptions, photos, and anything else) is accurate and that you have the right to share it. Please tell us promptly if your information changes.

We may edit submitted material for length, clarity, and style to fit the site’s voice.

5. License for Submitted Materials

You keep ownership of everything you submit, including your business name, logo, photos, and descriptions. By submitting, you grant us a non-exclusive, royalty-free license to use, reproduce, edit, display, and distribute those materials on the site and in our related channels, such as our social media, for the purpose of featuring and promoting your business and the site.

This license lasts as long as reasonably needed for those purposes. If your listing is removed, we will stop creating new uses of your materials, though copies may remain in past posts and archives.

6. Advertising and Feature Services

A basic listing is free. Separately, we offer optional paid services: featured coverage, sponsorship of a page or guide, giveaways, and event posts. Some are one-time and some are recurring. Details and current rates are on our pricing page. Paying for any of these is never a condition of being listed.

Services are billed as described on the pricing page or in the invoice we send you. Payment terms appear on the invoice. Purchasing a paid service does not change our editorial standards; see Section 3. We may decline to sell services to any business, and we may end a paid placement that violates these Terms or our content standards. If we sign a written agreement with you for a paid service, that agreement applies to it, and where it conflicts with these Terms, the written agreement controls.

Giveaways. Each giveaway runs under its own official rules, posted with the giveaway, which set out who can enter, how to enter, the dates, the prize, and how the winner is chosen. No purchase is ever necessary to enter or win, and a purchase does not improve your chances. Giveaways are void where prohibited. A giveaway run on social media is not sponsored, endorsed, or administered by, or associated with, that platform. The business that supplies a prize is responsible for providing it as described.

Refunds. Once a paid placement, feature, giveaway, or event post has gone live, that service is delivered and is not refundable. For a recurring service, you may cancel at any time; cancellation takes effect at the end of the current billing period, and any period already paid for runs to its end. If we cancel a recurring service ourselves for a reason other than your breach of these Terms, we will refund the unused portion of that period on a pro-rata basis. If we fail to deliver a service you have paid for, we will either deliver it or refund it in full, at your choice.

7. Acceptable Use

When using the site or our forms, you agree not to submit false, misleading, or infringing information or materials; impersonate another person or business; submit content that is unlawful, defamatory, harassing, or hateful; attempt to interfere with the site’s operation, scrape it at abusive volume, or probe it for vulnerabilities; or use our forms to send spam or content unrelated to a legitimate business or event submission.

We may block, decline, or remove anything that violates this section.

8. Our Content and Intellectual Property

The site’s original content (our writing, guides, photos we created, layout, branding, and the CSRA Night & Day name) belongs to the site operator. You may share links to our pages and quote brief excerpts with credit. You may not republish substantial portions of our content, or use our name or branding to imply endorsement, without written permission.

Business names, trademarks, and photos supplied by businesses belong to their respective owners. Their appearance on the site does not mean those owners endorse the site, or that we endorse them beyond the content of the listing itself.

Copyright complaints. If you believe something on the site uses your copyrighted work, including a photo, without permission, send us a notice through our contact page that identifies the work, the page where it appears, and how to reach you, and states that you own the work or are authorized to act for the owner. We will review it promptly and remove material that infringes.

9. Accuracy Disclaimer

We work to keep listings and event information accurate, but we describe third-party businesses that we do not control. Hours, prices, menus, offerings, and event details can change without notice. Always confirm important details directly with the business or event organizer before you go. We are not responsible for losses or disappointment caused by outdated or incorrect third-party information.

10. Third-Party Businesses and Links

Listings describe independent businesses. We are not a party to any transaction between you and a listed business, and we are not responsible for their products, services, pricing, safety, or conduct.

The site links to third-party websites and social media pages. We do not control those sites and are not responsible for their content or practices.

11. Warranty Disclaimer

The site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability, or fitness for a particular purpose. We do not promise the site will be uninterrupted or error-free.

12. Limitation of Liability

To the fullest extent allowed by law, the site operator will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the site, reliance on its content, or dealings with any listed business.

To the extent liability cannot be excluded, our total liability for any claim is limited to the amount you paid us for services in the twelve months before the claim arose, or one hundred US dollars if you paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

If you submit materials or purchase services, you agree to defend and hold the site operator harmless from claims, damages, and reasonable costs, including attorney fees, arising from your submitted materials, your breach of these Terms, or your business’s dealings with customers.

14. Termination and Removal

We may remove any listing or content, decline any submission, or end any paid service arrangement at any time, consistent with these Terms. If we end a prepaid service early for reasons other than your breach, we will refund the unused portion on a pro-rata basis as described in Section 6.

You may ask us to remove your business listing at any time by contacting us, and we will honor reasonable removal requests.

15. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the site after changes take effect means you accept the updated Terms. For material changes affecting paid services, we will make reasonable efforts to notify active advertising customers.

16. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Richmond County, Georgia, and both sides consent to that venue and to personal jurisdiction there. Before bringing a claim, please contact us first and give us 30 days to try to resolve it informally. Nothing in this section stops either side from using small claims court where it qualifies.
